PRIVACY NOTICE – GENERAL DATA PROTECTION REGULATION (GDPR)

GDPR brought in new legal protection for personal information from May 2018.

This tells you what personal information Innate Healing Company holds and why, and what your rights are.

The purpose of processing client data:

In order to give Reflexology treatments and provide reflexology classes, I will need to gather and retain potentially sensitive information about your/your child’s health. I will only use this information for the purposes of carrying our Reflexology treatments and classes and making associated recommendations concerning your health and wellbeing.

If you contact me via my Facebook page or by text or email, I will take basic contact details and information to allow me to contact you and handle bookings. If you provide me with any sensitive or medical/health information at the enquiry or booking stage, I will only hold and use this information if we proceed to treatment, otherwise it will be deleted.

Lawful basis for holding and using client information:

As a full member of the Federation of Holistic Practitioners (FHT), I abide by the FHT Code of Practice. The lawful basis under which I hold and use your information is legitimate interests. This means I need to retain your information in order to provide you with the best possible treatment options and advice. I hold special category data (i.e. health related information) in order for me to fulfil my role as a health care practitioner bound under the FHT Confidentiality as defined in the FHT Code of Practice.

What information I hold and what I do with it:

In order to give professional Reflexology treatments and classes, I will need to ask for and keep information about your/your child’s health. I will only use this for informing reflexology treatments and any advice I give as a result of your treatment and for contacting you about details of my services. The information to be held is:

• Your contact details.

• Medical history and other health-related information.

• Treatment details and related notes.

I will NOT share your information with anyone else (other than within my own practice, or as required for legal process) without explaining why it is necessary, and getting your explicit consent.

How long I retain your information for:

In line with the FHT’s code of practice;

• I must keep your information for a minimum of 10 years.

• Children’s records will be kept until at least 10 years after they reach adulthood.

• In case where there has been cause for concern, records must be kept indefinitely.

Your data will not be transferred outside the EU without your consent.

Protecting your personal data:

I am committed to ensuring that your personal data is secure. In order to prevent unauthorised access or disclosure, I have put in place appropriate technical, physical and managerial procedures to safeguard and secure the information I collect from you. I will contact you using the contact preferences you give me in relation to:

• Appointment times

• Reflexology information or information related to your health

Who else can see your information:

Innate Healing Company admin staff members have Scheduler role access. The Scheduler role is designed to perform a very limited number of functions and can only access a select few areas of Cliniko. Here’s what schedulers can do:

Book, view, modify, cancel, or archive appointments.

View basic patient details.

Create new patients and modify existing ones.

Unarchive patients.

Send SMS messages to patients.

View Contacts.

See all messages and comments on the dashboard, and post/modify/archive their own messages and comments.

View and modify their own user details.

View the following reports: appointments schedule (daily and weekly), missed appointments, and recalls.

A scheduler will never be able to see any of your financials or confidential patient details, such as treatment notes.

Your rights GDPR gives you the following rights:

• The right to be informed: To know how your information will be held and used.

• The right of access: To see your practitioner’s records of your personal information, so you know what is held about you and can verify it.

• The right to rectification: To tell your practitioner to make changes to your personal information if it is incorrect or incomplete.

• The right to erasure (also called “the right to be forgotten”): For you to request your practitioner to erase any information they hold about you

• The right to restrict processing of personal data: You have the right to request limits on how your practitioner uses your personal information

• The right to data portability: Under certain circumstances you can request a copy of personal information held electronically so you can reuse it in other systems.

• The right to object: To be able to tell your practitioner you don’t want them to use certain parts of your information, or only to use it for certain purposes.

• Rights in relation to automated decision-making and profiling.

• The right to lodge a complaint with the Information Commissioner’s Office: To be able to complain to the ICO if you feel your details are not correct, if they are not being used in a way that you have given permission for, or if they are being stored when they don’t have to be. Practitioner’s rights:

• If you don’t agree to me keeping records of information about you and your treatments, or if you don’t allow me to use the information in the way I need to for treatments, I may not be able to treat you.

• I have to keep your records of treatment for a certain period as described above, which may mean that even if you ask me to erase any details about you, I might have to keep these details until after that period has passed.

• I can move my records between different computers and IT systems, as long as your details are protected from being seen by others without your permission.
